House Committee Considers 12 Pot Plant Limit

There’s a debate in the State House over whether or not a committee can limit the number of marijuana plants which can be grown in a single residence.

The House Community and Regional Affairs Committee may take up a 12-plant-per-house limit as part of its bill addressing municipalities’ role in regulating marijuana.

Under the recently passed Ballot Measure 2, individuals are allowed up to six plants each, three of which may be mature. But some have questioned how that works in a household with multiple people growing their own plants.

However, staff from the Legislative Affairs legal services division wrote a memo, concerned that the proposed limit on plants would violate personal privacy and equal protection rights.
