Pebble Lawsuit to Have Its Day in Court

A lawsuit brought against the EPA by the Pebble Limited Partnership will soon be heard by a federal judge. The Partnership is arguing that the Agency had a predetermined goal to block the project…

 

Heatwole: “The EPA’s actions against Pebble right now are unprecedented in the history of the Clean Water Act, the 42-year history of the Clean Water Act. They’ve never preemptively sought to stop a project. This is about so much more than just whether or not a mine should go forward in Southwest Alaska.”

 

Mike Heatwole with the Partnership says the EPA violated a federal law by establishing and working with groups of mine critics that essentially acted as advisory committees but failed to notice meetings or provide transcripts.

 

On the other side, the federal agency says Pebble had “countless contacts” with the EPA. They say the lawsuit is Pebble’s way to undermine their ability to protect the Bristol Bay region.
