Anadromous Stream Ordinance Postponed Due to Technicality

An ordinance before the borough assembly which would change anadromous stream codes to only apply to the Kenai and Kasilof Rivers was postponed Tuesday night.

 

Assembly President Dale Bagley created the ordinance which would change the borough codes that mandate a 50 foot buffer on anadromous streams all over the peninsula to just the Kenai and Kasilof Rivers.

 

He said due to a technicality the ordinance was postponed until the assembly’s July 7 meeting.

Bagley: “The planning commission has not had a chance to take action on this and anything that is a zoning issue needs to go before the planning and zoning committee before the assembly can deal with this.”

 

The assembly still took public testimony on the ordinance Tuesday night though, which Bagley said was mostly in favor of keeping the codes which apply to all lakes, rivers and streams.

 

He said he would like to put the issue to a vote but that will not happen because zoning matters cannot be decided in that manner.
