On December 9 Rosendo Pallones plead not guilty to allegations of a sexual assault between he and another cannery worker from this summer.

A Kenai Grand Jury indicted Pallones December 5 on three counts of first-degree sexual assault Friday. One of the original four counts was dismissed at a preliminary hearing on November 26 due to lack of probable cause.

Based on the trooper report of the alleged event, the victim said they and she and four co-workers were hanging out in a bunk room of the cannery when everyone left to get ready for shift. Pallones allegedly came back in the room and forced himself on her while she continued to say not and cry. Soon a friend  came back and told him to leave. Her story was corroborated by the co-worker who came back.

Troopers had received the call that evening accusing Pallones of the sexual assault and stopped him in his green Honda Passport after he had left.

His story was that he gave the victim a back rub and “one thing led to another” and he began touching her genitals but also said she was crying and saying no and he did not stop when she asked.

Pallones is in Wildwood in custody until his next court date on January 30, 2015.
