House Passes Local Option Bill for Recreational Marijuana

The Alaska House of Representatives has passed a bill which could give local governments’ greater control of recreational marijuana.

 

House Bill 75 details the base of recreational marijuana taxation and regulation which municipalities can build on.

 

That legislation would set a 24 plant limit and provides for “marijuana clubs” as a new type of commercial establishment.

 

As followup, a protest and review process of commercial establishment is also provided, along with the ability for established villages to “opt out” of those operations within their boundaries.

 

The bill more clearly defines “assisting” and clarifies for municipalities that their general power to regulate alcohol establishes and allows them to regulate marijuana establishments.

 

That bill will now move to the Senate.
