JBER Sgt. 1st Class Indicted For Assault

On Nov. 19, an Anchorage grand jury indicted 39-year-old Sgt. 1st Class Damian Rodriguez on one count of Assault in the First Degree, one count of Assault in the Second Degree, two counts of Assault in the Third Degree, one count of Coercion, one count of Terroristic Threatening, and one count of Tampering with Physical Evidence.

 

On Sept. 29, Rodriguez allegedly threatened to kill, then strangled and beat his girlfriend.

 

Rodriguez was arraigned in Anchorage Superior Court on Friday, Nov. 29.  Rodriguez is a soldier in the U.S. Army and is stationed at Joint Base Elmendorf-Richardson.

 

This case was investigated by the Anchorage Police Department’s Domestic Violence Unit in partnership with the U.S. Army’s Criminal Investigative Division.

 

The charges in the indictment are only allegations and do not constitute evidence of guilt. Rodriguez is presumed innocent and is entitled to a fair trial at which the prosecution must prove his guilt beyond a reasonable doubt.
