A Kenai grand jury on Wednesday returned a twelve-count indictment charging 30-year-old Josiah Kelly with various crimes related to three shooting incidents in Homer.

On Oct. 19, 2024, at 8:16 p.m., Kelly allegedly shot into a building in downtown Homer that was being used by Katchemak Bay Recovery Connections. He was indicted for Misconduct Involving Weapons in the Second Degree, Criminal Mischief in the Third Degree, and Terroristic Threatening in the Second Degree related to this incident.

On Nov. 11, 2024, at 5:48 a.m., Kelly allegedly shot from a pick-up truck he was operating into a building belonging to Katchemak Bay Family Planning. Kelly returned at 6:50 p.m. and again allegedly shot from a pick-up truck he was operating into the same building. He was indicted for two counts of Misconduct Involving Weapons in the First Degree, two counts of Misconduct Involving Weapons in the Second Degree, Criminal Mischief in the Third Degree, Terroristic Threatening in the Second Degree, and three counts of Assault in the Third Degree related to the two shootings at Family Planning.

Homer Police apprehended Kelly soon after the second shooting on Nov. 11.

Misconduct Involving Weapons in the First Degree is an A felony, and Misconduct Involving Weapons in the Second Degree is a B felony. The other charges – Criminal Mischief in the Third Degree, Terroristic Threatening in the Second Degree, and Assault in the Third Degree are all C felonies.

These charges are only allegations and do not constitute evidence of guilt. All defendants are presumed innocent and are entitled to a fair trial at which the prosecution must prove their guilt beyond a reasonable doubt.
