The Kenai Peninsula Borough Assembly voted through consent agenda to accept a parcel of land that was willed to the borough.
Assemblymember Richard Derkevorkian:
“This was authorizing the acquisition by bequeathment of 41.75 acres of land located in the Nikiski area. This is a section of land down on Holt Lamplight that the gentlemen had willed to the Borough. This resolution will allow the Borough to accept the title for the land. There’s some discussion around what the land was intended to do. It’s in the best interest in the Borough to accept this land.”
The bequeathment provides that the gift of the property is ‘for wildlife preservation’, however, the borough notified the estate that the borough doesn’t have areawide wildlife preservation, wildlife management, or recreational powers, and therefore the borough can’t commit resources or funds to actively manage the property for wildlife preservation.
The Estate of Thomas A. Toloff notified the Kenai Peninsula Borough in 2020 that his Last Will and Testament bequeathed to the borough a parcel of property in the Nikiski area. The borough notified the estate that they won’t accept any deed restrictions that require the property to be held for wildlife preservation in perpetuity.

The estate provided a valid, executed Personal Representative’s Deed without any restrictions on June 25, 2021, which is used to sell a decedent’s property in Alaska.
On September 13, 2021, the KPB Planning Commission, at its regularly scheduled meeting, recommended approval by majority consent.
