The Alaska Department of Law filed new charges against the two Homer brothers who were believed to have been involved in a 2012 assault of a teenage boy.
On December 24 the charges were filed in the Homer Courthouse and 22 year-old Anthony Resetarits now faces felony charges of first-degree hindering prosecution and tampering with felony evidence.
He and his 20 year-old brother Joseph Resetarits both face a charge of one count each of second degree harrassment which is a misdemeanor.
Neither of the men have been arrested or arraigned.
Kenai Superior Court Judge Carl Bauman dismissed the men’s previous charges of second-degree sexual assault in August after Joseph’s lawyer filed a motion arguing the state provided insufficient evidence to support an indictment along with some evidence presented had been hearsay and had prejudiced the grand jury.
In the 2012 charging documents from the Alaska State Troopers the two brothers were allegedly involved in sexually assaulting a then 17 year old boy who had passed out during a party at an East End Road home.
At the time of the event, witnesses had said there were photographs and videos taken on cell phones of the assault but Alaska State Troopers were only able to recover one photo related to the incident.
