A federal judge has again thrown out the Pebble Ltd Partnership’s lawsuit against the Environmental Protection Agency.
The 9th U.S. Circuit Court of Appeals today agreed with a previous decision that the suit is premature, since the EPA hasn’t taken its final actions in the ongoing debate over the proposed Pebble Mine.
The case was first dismissed last September. Mike Heatwole with the Partnership says it’s an issue of timing…
Heatwole: “The EPA has maintained that they have not taken a final action on Pebble, all of us know where they’re going when it comes to preemptively stopping the project. We just have to wait now until they take a final action before we get to take the merits of our case into the court room.”
Pebble says the EPA actively worked with mine critics and essentially treated them as advisory groups. The EPA says they had similar contact with the Partnership.
