Senate Passes HB 75: Amending Plants in Possession, Background Checks

The Alaska Senate passed HB 75 Wednesday, a bill regarding growing and possessing marijuana as well as background checks for canna-business applicants.

 

Before approval by an 18-2 vote, Senators amended the legislation to only allow 12 plants in a single home, with six or fewer being mature, flowering plants no matter how many individuals 21 years or older live in the residence.

 

The new version of the bill also included a clause prohibiting marijuana establishments, testing facilities, and retail stores in “unorganized boroughs”, requiring them to “opt in” to allow those.

Ostrander: “The Kenai Peninsula Borough is an incorporated area, so it is an organized borough, and we will not have to opt in. The rules apply to the Kenai Peninsula Borough the same as they apply to the other municipalities, the other cities within the borough: Kenai, Soldotna, etc.”

 

The term unorganized borough was derived from the Borough Act of 1961, which includes approximately 323,440 square miles of Alaska not within a unified, home rule, first or second class borough. The Kenai Peninsula is a second class borough.

In House Bill 75, the Senate also included requirements for canna-business applicants to be fingerprinted and required to pay the fees for both state and national criminal background checks.

 

Regulations on marijuana smoking clubs have been left up to the Alaska Alcohol & Marijuana Control Board to configure.

 

HB 75 now goes back to the House for a vote on the amendments.
