On September 29 Kenai Police officers responded to a report of a woman using drugs in a Kenai supermarket restroom.
Officers contacted 30 year-old Heidi Porter of Nikiski and found her to be in possession of marijuana and heroin. Porter was arrested and transported to Wildwood Pre-Trial Facility for misconduct involving controlled substance 4 and 6.
The investigation also found 31 year-old Jerry Rogerss of Nikiski to be in possession of heroin and was arrested on misconduct involving controlled substance 4 and a probation violation.
Thursday morning the two appeared in court for arraignment.
Rogerss has a prior felony of misconduct involving controlled substance from 2013 and another from 2011 which was reduced to a misdemeanor.
The state attorney asked for $5,000 bail and a third party, saying they were not worried about him not showing up but were worried about his history of drugs pattern continuing.
This is Porter’s first class C felony, however she did have a previous charge of theft in the fourth degree in 2003.
The state attorney asked for $2000 bail or a third party.
Both were instructed not to contact each other directly or indirectly as they are co-defendants. Rogerss stated Porter is his girlfriend and Judge Martin Fallon said those conditions may be taken up with their public defenders.
